PhantexVPN — Terms of Use (EULA)

1. Description of Service

PhantexVPN is a Virtual Private Network (VPN) application that provides encrypted internet connectivity to protect your online privacy and security. The App offers:

• VPN Connectivity via multiple protocols including WireGuard, IKEv2, and Shadowsocks
• Global Server Network across multiple countries and regions
• Premium Features including premium server locations, ad and tracker blocking, custom DNS configuration, split tunneling, detailed connection statistics, and unlimited bandwidth (available to subscribers)
• Free Tier with access to selected servers and basic VPN functionality

We reserve the right to update, modify, improve, or discontinue any part of the service at any time for maintenance, performance optimization, security enhancements, or legal compliance, with or without prior notice.

2. Apple Platform Terms

If you access or download PhantexVPN through the Apple App Store, your use of the App is also subject to the Apple Standard Licensed Application End User License Agreement. These Terms supplement Apple's EULA with product-specific rules for PhantexVPN, including but not limited to subscription pricing, billing cycles, acceptable use policies, support channels, and service limitations.

In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall prevail to the extent required by Apple's policies.

Apple is not a party to these Terms and has no obligation to furnish any maintenance or support services with respect to PhantexVPN. Apple is not responsible for any product warranties, claims, losses, liabilities, or costs related to PhantexVPN.

3. Auto-Renewable Subscriptions and Billing

PhantexVPN offers the following auto-renewable subscription plans:

Monthly Plan

• Price: US $2.99 per month
• Billing: Billed monthly. Auto-renews unless canceled at least 24 hours before the end of the current billing period.

Yearly Plan

• Price: US $24.99 per year (equivalent to approximately $2.08/month)
• Free Trial: Includes a 7-day free trial for eligible new subscribers. The free trial is available once per Apple ID.
• Billing: After the free trial ends, $24.99/year is charged. Auto-renews unless canceled at least 24 hours before the end of the current period.

Billing Terms

• Payment is charged to your Apple ID account at the confirmation of purchase, or at the end of the free trial period if applicable.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription rate for your selected plan.
• Free Trial: If you cancel during the free trial period, you will not be charged. Any unused portion of a free trial period will be forfeited when you purchase a subscription.
• Regional Pricing: Actual pricing at checkout may vary based on your App Store region and local currency. The localized price displayed at checkout in the App Store is the price that will be charged.

4. Managing and Canceling Subscriptions

• You can manage, upgrade, downgrade, or cancel your subscription at any time through Settings > Apple ID > Subscriptions on your Apple device, or through the App Store.
• Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the period you have already paid for.
• No partial refunds are issued for the remaining portion of any billing period, unless required by applicable law.
• Previously purchased subscriptions can be restored using the "Restore" button on the paywall screen or in the App settings.
• For billing disputes, refund requests, or payment method changes, please contact Apple Support directly.

5. Acceptable Use Policy

You agree to use PhantexVPN solely for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. You agree not to:

• Use the App for any unlawful, fraudulent, or malicious activity
• Engage in abusive network behavior, including but not limited to denial-of-service attacks
• Attempt unauthorized access to any systems, networks, or data
• Distribute malware, viruses, or other harmful software through the VPN connection
• Send spam, unsolicited communications, or engage in phishing
• Interfere with or disrupt networks, services, servers, or other users
• Use the App to circumvent lawful content restrictions in a manner that violates applicable law
• Resell, redistribute, or sublicense access to PhantexVPN without our written consent

We reserve the right to limit, suspend, or terminate your access to PhantexVPN if misuse, fraud, excessive abuse, or security threats are detected, at our sole discretion and without prior notice.

6. Intellectual Property

PhantexVPN, including its design, code, graphics, logos, trademarks, and content, is the property of Cyborgate and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works of the App or any part thereof without our prior written consent.

7. Service Availability and Disclaimers

PhantexVPN is provided on an "AS AVAILABLE" and "AS IS" basis. We strive for maximum uptime and performance, but we do not guarantee:

• Uninterrupted, continuous, or error-free availability of the service
• Specific connection speeds, latency, or throughput
• Access to every server region or location at all times
• Complete anonymity, privacy, or protection against all online threats

While PhantexVPN significantly improves your online privacy and security through encryption, no VPN service can guarantee complete anonymity or absolute protection against all threats. Users are responsible for their own compliance with applicable local laws when using VPN services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBORGATE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CYBORGATE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF PHANTEXVPN, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Privacy

Your use of PhantexVPN is governed by our Privacy Policy, which details how we collect, use, and protect your information, including account data, diagnostic information, and subscription-related data.

PhantexVPN follows a strict no-logs policy — we do not monitor, record, or store your browsing activity, connection timestamps, DNS queries, or IP addresses while connected to our VPN servers.

Please review the Privacy Policy carefully before using the App.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this document. Your continued use of PhantexVPN after any modifications constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
