VPN MAX PRO — Terms of Use (EULA)

1. Description of Service

VPN MAX PRO is a Virtual Private Network (VPN) application that provides encrypted internet connectivity to protect your online privacy and security. The App may offer:

• VPN Connectivity via protocols such as WireGuard, IKEv2, and Shadowsocks (availability may vary by platform)
• Global Server Network across multiple countries and regions
• Premium Features including premium server access, connection statistics, split tunneling, and custom DNS (available to subscribers where offered)
• Free Tier with access to selected servers and basic VPN functionality, where available

We may update, improve, suspend, or remove parts of the service when needed for security, maintenance, performance, product changes, or legal compliance, with or without prior notice.

2. Apple Platform Terms

If you access or download VPN MAX PRO through the Apple App Store, your use of the App is also subject to the Apple Standard Licensed Application End User License Agreement. These Terms supplement Apple's EULA with product-specific rules for VPN MAX PRO, including subscription pricing, billing, acceptable use, support, and service limitations.

In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall prevail to the extent required by Apple's policies.

Apple is not a party to these Terms and has no obligation to furnish maintenance or support services for VPN MAX PRO. Apple is not responsible for product warranties, claims, losses, liabilities, or costs related to VPN MAX PRO.

3. Auto-Renewable Subscriptions and Billing

VPN MAX PRO offers auto-renewable subscription plans. Subscription availability and pricing may vary by platform (Apple App Store or Google Play) and region.

Monthly Plan

• Price: US $1.99 per month
• Billing: Billed monthly. Auto-renews unless canceled at least 24 hours before the end of the current billing period.

Yearly Plan

• Price: US $17.99 per year
• Free Trial: May include a 3-day free trial for eligible new subscribers. Trial eligibility is determined by the platform store and is typically limited to one trial per account.
• Billing: After any free trial ends, $17.99/year is charged. Auto-renews unless canceled at least 24 hours before the end of the trial or current period.

Billing Terms

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase, or at the end of a free trial if a trial applies.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Free Trial: If you cancel during a free trial, you will not be charged. Unused trial time may be forfeited if you purchase a subscription before the trial ends.
• Regional Pricing: Localized storefront pricing shown at checkout controls if your store displays a different amount or currency.

4. Managing and Canceling Subscriptions

• On iOS, manage or cancel subscriptions in Settings > Apple ID > Subscriptions or via the App Store.
• On Android, manage or cancel subscriptions in Google Play under Payments & subscriptions.
• Canceling stops the next renewal but does not automatically refund the current billing period unless required by law or granted by Apple or Google.
• You retain access to premium features until the end of the period already paid for.
• You can restore eligible purchases from within the App where that feature is available.
• For billing disputes, refunds, or payment method changes, contact Apple Support or Google Play Support, as applicable.

5. Acceptable Use Policy

You agree to use VPN MAX PRO only for lawful purposes and in compliance with applicable laws. You agree not to:

• Use the App for unlawful, fraudulent, or malicious activity
• Engage in abusive network behavior, including denial-of-service attacks
• Attempt unauthorized access to systems, networks, or data
• Distribute malware, viruses, or other harmful software through the VPN
• Send spam, unsolicited communications, or engage in phishing
• Interfere with networks, services, servers, or other users
• Resell, redistribute, or sublicense access to VPN MAX PRO without our written consent

We may limit, suspend, or terminate access where misuse, fraud, or security risks are detected, at our discretion and without prior notice.

6. Intellectual Property

VPN MAX PRO, including its design, code, graphics, logos, trademarks, and content, is the property of Cyborgate and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works of the App without our prior written consent, except as permitted by law.

7. Service Availability and Disclaimers

VPN MAX PRO is provided on an "AS AVAILABLE" and "AS IS" basis. We do not guarantee:

• Uninterrupted, continuous, or error-free availability
• Specific connection speeds, latency, or throughput
• Access to every server region or location at all times
• Complete anonymity or protection against all online threats

Using a VPN can improve privacy, but it does not eliminate all security risks or create a guarantee of anonymity. Users are responsible for complying with local laws when using VPN services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBORGATE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CYBORGATE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF VPN MAX PRO, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Privacy

Your use of VPN MAX PRO is also governed by our Privacy Policy, which explains how we handle account, diagnostic, and subscription-related information.

VPN MAX PRO follows a strict no-activity-logs policy as described in the Privacy Policy. Please review it together with these Terms before using the service.

10. Changes to These Terms

We may modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of VPN MAX PRO after changes constitutes acceptance of the updated Terms.

We encourage you to review these Terms periodically.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom, unless mandatory consumer protection laws in your country of residence provide otherwise.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
