Introduction
Welcome to Poka, an AI-assisted communications app that helps you place phone calls, send SMS messages, book reservations, set reminders, and run related tasks using natural language voice or text commands.
Cyborgate ("we," "us," or "our") operates the Poka mobile application (the "App"). This Privacy Policy explains what information we collect, how we collect it, how we use it, who we share it with (including third-party AI services), and the choices available to you.
By installing or using the App, you agree to the practices described in this policy. If you do not agree, please do not use the App. Your use is also governed by our Terms of Use.
Important: Reading this Privacy Policy alone is not a substitute for in-app consent. Where personal data is shared with a third-party AI service, the App will explain what is sent, identify the recipient, and ask for your permission before that sharing occurs.

Summary of Data Practices
In plain language:
- Commands: What you say or type (and related details needed for the request) may be processed by Google Gemini (Google's Gemini AI API) so Poka can understand your intent.
- Calls & SMS: Destination numbers, call prompts, and message content may be sent to Poku Labs to place AI-assisted calls and SMS on your behalf.
- Optional profile data: You may optionally provide your name, phone number, and email address. If you choose to share them on a call, they may be included in data sent to Poku Labs.
- Permission first: Personal data is not sent to Google Gemini or Poku Labs until you affirmatively allow AI data sharing in the App.
- We do not sell your personal information.
Section 3
Information We Collect
We collect information in the following categories depending on how you use the App and which permissions or optional fields you choose:
3.1 Optional personal information you provide
You may choose to enter the following information. Providing it is optional and not required for every feature:
- Name
- Phone number
- Email address
If you submit these fields and opt to share them on a command, they may be transmitted to Poku Labs as described in Sections 5, 6, and 7. You will be informed in the App what is being sent and asked for permission before third-party AI sharing occurs.
3.2 Commands and call-related information
- Voice and text commands: Commands you speak or type, including transcripts, parsed intent, contact names, phone numbers, messages, reservation details, and reminder text.
- Destination number or contact: The phone number you select from your contacts or enter manually to call or text.
- Call description / message intent: The text or spoken description you provide about what you want said or conveyed on the call or in an SMS.
- Call and messaging metadata: Timestamps, call status, duration (when available), interaction IDs, summaries, recording URLs, and related operational logs needed to complete and support the request.
3.3 Contacts (device permission)
- Contacts: Names and phone numbers from your device address book when you grant Contacts permission. Contact data is used so you can pick who to call or text. Contact data is processed on your device for selection and is only transmitted as needed to fulfill a command you initiate (for example, the selected number and related message or call description).
3.4 Voice, location, and device inputs
- Microphone / speech (if enabled): Audio or speech-to-text content when you dictate a command or call description.
- Location (if enabled): Approximate or precise location when you grant Location permission, used for "near me" searches and place-related requests while the App is in use.
- Device and usage data: Device model, operating system version, app version, crash logs, and diagnostic events needed to maintain and improve the App.
3.5 Account, subscriptions, and notifications (if used)
- Account or sign-in identifiers: If you sign in, we may receive identifiers such as name, email, or authentication tokens from the provider you choose (for example Google or Apple).
- Subscription and purchase data: Plan tier, call credits or minutes, and transaction receipts processed through Apple App Store or Google Play billing.
- Notifications: Push notification tokens and reminder schedules if you enable notifications or create reminders.

How We Collect Information
- Directly from you: Optional name, phone, and email you type into the App; commands and call descriptions you write or speak; numbers you enter; and account or purchase actions you take.
- From your device (with permission): Contacts, microphone, location, and notification tokens, only after you grant the relevant system permission.
- Automatically: Limited device, diagnostic, and usage information generated while you use the App.
- From platform providers: Purchase validation and authentication signals from Apple or Google when you use those features.

How We Use Your Information
We use collected information to:
- Understand and execute your voice and typed commands using Google Gemini.
- Place outbound calls and send SMS through Poku Labs and carriers on your behalf, using the description you provide.
- Resolve selected contacts to phone numbers and validate number formats.
- Look up publicly listed business phone numbers when needed to complete a request you start.
- Schedule reminders and deliver local or push notifications you enable.
- Provide subscription features, track included minutes or credits, and process purchases (if applicable).
- Improve reliability, support, and user experience.
- Detect abuse, fraud, and technical issues.
- Comply with legal obligations and enforce our Terms of Use.
We do not use your contacts, messages, call recordings, or optional profile fields to train public AI models without your separate explicit consent.

Third-Party AI Services (Google Gemini & Poku Labs) — What Is Sent & Permission
Poka uses two third-party AI-related service providers to power core features:
- Google Gemini (Google's Gemini AI API) — command understanding, intent parsing, and public business number lookup.
- Poku Labs — AI-assisted outbound calling and SMS, including call summaries and recordings when available.
6.1 What data may be sent to Google Gemini
- Voice or text commands you enter (including transcripts of what you say).
- Contact names, phone numbers, messages, and reservation details needed to parse and complete a request you start.
- Approximate location when you ask for nearby places (if Location permission is on).
6.2 What data may be sent to Poku Labs
- Call prompts and the description of what you want said on the call.
- Destination phone numbers and SMS message content for actions you initiate.
- Optional profile fields you choose to share on a call (name, phone number, email).
- Limited technical context required to complete the request (for example, language preference or request identifiers), when necessary to operate the feature.
6.3 Who the data is sent to
Command-related data described above is sent to Google via the Gemini AI API. Call and SMS data is sent to Poku Labs, our third-party AI telephony provider, solely to provide the features you request.
6.4 Permission before sharing
Before personal data is shared with Google Gemini or Poku Labs, the App will:
- Disclose what data will be sent;
- Identify that the recipients are Google Gemini and/or Poku Labs (as applicable); and
- Obtain your permission before sending that data (for example, through an in-app AI & Data Sharing consent screen).
You can decline AI data sharing. If you decline, AI command parsing, AI calls, SMS, and number lookup stay unavailable until you allow sharing. Other non-AI parts of the App may still be browsable subject to other requirements (such as subscriptions or device permissions).
6.5 Equal protection
We require third parties that process personal data on our behalf, including Google (for Gemini) and Poku Labs, to provide the same or equal protection of that data consistent with this Privacy Policy and applicable law, and to use the data only to provide services to us and to you—not for their independent marketing.
Section 7
How We Share Information
We may share information with:
- Google Gemini (Google) — third-party AI API for command understanding and related lookups, as described in Section 6.
- Poku Labs — third-party AI telephony provider, as described in Section 6 (call prompts, destination numbers, SMS content, optional shared profile fields).
- Telephony providers and carriers — used by Poku Labs to place outbound calls and SMS you initiate.
- Apple and Google — for authentication, in-app purchases, platform services, and (for Gemini) AI processing as described above.
- Analytics and crash reporting tools — to monitor stability and performance (where used).
- Law enforcement or regulators — when required by law, court order, or to protect rights, safety, and security.
- A successor entity — in connection with a merger, acquisition, or asset sale, subject to this policy.
We do not sell your personal information. We do not share your full contact list with third parties for their independent marketing purposes.
Section 8
Device Permissions
The App may request the following permissions. You may deny any permission, but some features will not work without it:
- Contacts: To let you select people to call or text from your address book.
- Microphone: To capture spoken commands or call descriptions (if you use voice input).
- Speech Recognition: To convert speech to text on supported devices.
- Location (While Using): To find nearby restaurants and places when you ask.
- Notifications: To deliver status, reminder, or scheduled command alerts you enable.
- Siri / Shortcuts (iOS): To launch the App and pass voice intents hands-free.
Section 9
Data Storage & Retention
Some data may be stored locally on your device (for example, preferences, command history, drafts, reminders, and subscription balances). Server-side and partner-processed data is retained only as long as needed to operate the service, resolve disputes, meet legal requirements, and maintain billing records.
Retention periods may vary by data type and jurisdiction. You may delete local data from within the App where available. Uninstalling the App removes locally stored data from your device, subject to platform backup behavior.

Section 10
Your Rights & Choices
Depending on your location, you may have rights to:
- Access, correct, or delete personal information we hold about you.
- Allow or withdraw permission for third-party AI data sharing in the App (AI & Data Sharing). Without this permission, AI command parsing, AI calls, SMS, and number lookup stay unavailable.
- Decline optional name, phone, and email fields or contact-sharing on calls.
- Withdraw consent for optional processing where consent is the legal basis.
- Revoke device permissions at any time in iOS or Android Settings.
- Cancel subscriptions through your App Store or Play Store account settings.
- Request a copy of your data or object to certain processing activities.

Section 11
Children's Privacy
The App is not directed to children under 13 (or the minimum age required in your country). We do not knowingly collect personal information from children.
If you believe a child has provided us information, contact us and we will take steps to delete it.
Section 12
Security
We use administrative, technical, and organizational measures designed to protect your information, including encrypted transport (HTTPS/TLS) for network communications.
No method of transmission or storage is completely secure. You use the App at your own risk and should protect your device with a passcode or biometric lock.
Section 13
International Users
If you use the App outside your home country, your information may be processed in countries with different data protection laws than your own, including jurisdictions where Cyborgate, Google, Poku Labs, or telephony partners operate.
Where required, we implement appropriate safeguards for cross-border transfers.
Section 14
Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where appropriate, provide additional notice in the App.
Continued use of the App after changes become effective constitutes acceptance of the updated policy.
