Section 1

1. Agreement to Terms

These Terms of Use ("Terms," "Agreement," or "EULA") represent a binding legal agreement between you ("User," "you," or "your") and Cyborgate ("Company," "we," "us," or "our"), regarding your access to and use of the HabitPal mobile application on the Apple App Store, including any associated updates, features, cloud sync services, and AI assistants.

By downloading, installing, registering for, or using HabitPal, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the App and must delete it from your devices immediately.

Section 2

2. License Grant & Intellectual Property

Subject to your compliance with these Terms, Cyborgate grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable limited license to download, install, and execute HabitPal on authorized Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and Conditions.

All copyrights, trademarks, logos, visual designs, custom icons, graphics, animations, code, and trade secrets in HabitPal are the exclusive intellectual property of Cyborgate. You agree not to reverse engineer, decompile, disassemble, modify, or create derivative works based on the App.

Section 3

3. Subscriptions & In-App Purchase Terms (Apple StoreKit)

HabitPal offers premium subscription tiers ("HabitPal Pro") that unlock unlimited custom habits, full lifetime history, AI assistant coaching, advanced widgets, and family pod sharing:

HabitPal Monthly Pro: Billed monthly, cancel anytime.
HabitPal Yearly Pro (Best Value): Includes a 7-day free trial; billed annually thereafter.
HabitPal Family Yearly: Supports shared pod motivation for up to 5 members or partners.

Auto-Renewal Terms & Cancellation:
• Payment: Payment is charged to your Apple ID account at confirmation of purchase or at the conclusion of your 7-day free trial period.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is disabled at least 24 hours before the end of the current billing cycle.
• Renewal Billing: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• Managing & Cancelling: You can manage or cancel your subscription at any time in your iPhone/iPad Settings: Settings → [Your Name] → Subscriptions.
• Refunds: All purchase transactions and refund requests are handled exclusively by Apple Inc. in accordance with Apple App Store policies.

4. AI Assistant Features & Health/Wellness Disclaimer

HabitPal integrates generative AI capabilities powered by Google Gemini to deliver interactive habit coaching, milestone summaries, and motivational partner banter ("Taunts").

IMPORTANT HEALTH & MEDICAL DISCLAIMER:
HabitPal and its AI features are designed solely for self-motivation, general wellness tracking, and productivity organization. HabitPal is NOT a medical device, nor does it offer clinical, psychological, psychiatric, nutritional, or medical diagnosis or treatment.

Always consult a licensed physician, registered dietitian, or qualified healthcare professional before beginning any new exercise regimen, restrictive fasting routine, or medication schedule. Never disregard or delay seeking professional medical advice because of information presented in HabitPal.

4.1 AI Conduct & Limitation of Output Accuracy

Artificial intelligence models produce probabilistic outputs. While we strive to maintain high quality and constructive coaching, Cyborgate does not guarantee the accuracy, completeness, or suitability of any suggestion generated by the AI assistant.

Section 5

5. Shared Pods & User Conduct Guidelines

HabitPal enables users to connect with accountability partners and create shared motivation pods. You agree to maintain respectful, civil, and supportive conduct at all times:

You will not use custom habit titles, notes, or nicknames to transmit abusive, hateful, defamatory, obscene, harassing, or threatening content.
You will not impersonate any person or entity or misrepresent your pod identity.
You will not attempt to gain unauthorized access to any other user's pod data or disrupt the Firebase sync infrastructure.

Cyborgate reserves the right to immediately terminate or suspend access to shared pod features for any user who violates these conduct standards.

Section 6

6. Account Deletion & Termination

You may terminate this Agreement at any time by uninstalling the App. Furthermore, you may permanently purge your cloud account, pod associations, and all logged data via the in-app Settings → Delete Account & Data option.

Cyborgate reserves the right to discontinue or modify the App or any part thereof at any time, with or without notice.

7. Disclaimer of Warranties & Limitation of Liability

HABITPAL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, CYBORGATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Section 8

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts of London, England, subject to mandatory local consumer rights that cannot be waived.
